47 U.S.C. § 230 makes the amendment to Section 230 retroactive, stating that the amendment “shall apply regardless of whether the conduct occurred … before, on, or after” the date of enactment.

Retroactive
reading U.S. Codes that haven't been updated and were posted a long time ago on the internet, before the codes and sections have been amended by Congress in 2018, is a meaningless exercise if one wants to understand their current application to the law.
47 U.S.C.; the Communications Act of 1934 and the Electronic Communications Privacy Act of 1986, have been amended FOSTA § 4(a) codified at 47 U.S.C. § 230. FOSTA makes the amendment to Section 230 retroactive. FOSTA § 4(b) alleged conduct is retroactive, it shall apply whether the conduct occurred before, on, or after, the date of enactment of the amendment for those of you that dream in your sleep of fighting the U.S. government in federal court on unconstitutional prosecution of federal statutes used against you, first pay your cash bond using the equity in your home and withdraw your life's savings from the bank to get yourself out on bail, go win the powerball lottery, then retain a team of great criminal defense attorneys, and check back with us in 8 years after you have appealed your case up to the Ninth Circuit Court and be sure to let us know how bankrupt and old you are now Last edited by Drukpa Kunley; April 27th, 2018 at 11:56 PM. |

"SEC. 4. Ensuring ability to enforce federal and state criminal and civil law relating to sex trafficking. (a) In General.—Section 230(e) of the Communications Act of 1934 (47 U.S.C. 230(e)) is amended by adding at the end the following: “(5) NO EFFECT ON SEX TRAFFICKING LAW.—Nothing in this section (other than subsection (c)(2)(A)) shall be construed to impair or limit— “(A) any claim in a civil action brought under section 1595 of title 18, United States Code, if the conduct underlying the claim constitutes a violation of section 1591 of that title; “(B) any charge in a criminal prosecution brought under State law if the conduct underlying the charge would constitute a violation of section 1591 of title 18, United States Code; or “(C) any charge in a criminal prosecution brought under State law if the conduct underlying the charge would constitute a violation of section 2421A of title 18, United States Code, and promotion or facilitation of prostitution is illegal in the jurisdiction where the defendant’s promotion or facilitation of prostitution was targeted.”.
