Retroactive
reading U.S. Codes that haven't been updated and were posted a long time ago on the internet, before the codes and sections have been amended by Congress in 2018, is a meaningless exercise if one wants to understand their current application to the law.
47 U.S.C.; the Communications Act of 1934 and the Electronic Communications Privacy Act of 1986, have been amended
FOSTA § 4(a) codified at 47 U.S.C. § 230. FOSTA makes the amendment to Section 230 retroactive. FOSTA § 4(b)
alleged conduct is retroactive, it shall apply whether the conduct occurred before, on, or after, the date of enactment of the amendment
